2. Acceptance of Terms

6. Equipment Rental Terms

 

Rental Agreements:

These Equipment Rental Terms ("Terms") govern the rental of equipment through Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Company’s ("we," "us," or "our") peer-to-peer equipment exchange platform. By renting equipment ("Equipment") through our Services, you ("Renter") agree to comply with these Terms, as well as our general Terms of Service and any additional policies referenced herein.

 

1. Rental Periods

  • Definition of Rental Period: The Rental Period is only for the time selected and ends when the Equipment is returned to and accepted by the Owner or designated return location. Late returns can incur a late fee.

  • Minimum and Maximum Duration: Rental durations are specified by the Equipment Owner and may have minimum or maximum rental periods. Renters must adhere to these specified durations.

  • Extensions: Any extension of the Rental Period must be agreed upon by both the Renter and the Equipment Owner through our platform before the original Rental Period expires. Additional fees apply.

 

 

2. Rental Fees and Deposits

  • Rental Fees: The Rental Fee is the total amount payable for the use of the Equipment during the agreed Rental Period. Fees are determined by the Equipment Owner and are displayed on the Equipment listing and calculated at the final checkout process.

  • Security Deposits:

    • Amount: A refundable Security Deposit may be required by the Equipment Owner or our company. The amount will be specified in the Equipment listing.

    • Payment: The Security Deposit must be paid at the time of booking and will be held by us in escrow.

    • Refund: The Security Deposit will be refunded to the Renter upon the satisfactory return and inspection of the Equipment, less any applicable charges for damage, loss, or late return.

  • Payment Processing: All payments, including Rental Fees and Security Deposits, must be made through our platform using the provided payment processing services. We do provide cash only services that incur a fee under limited circumstances.

 

3. Late Return Policies

  • Obligation to Return on Time: Renters are obligated to return the Equipment by the agreed-upon return date and time specified in the Rental Agreement.

  • Late Fees:

    • Calculation: Late returns may incur additional fees, which may include an hourly or daily rate as specified by the Equipment Owner or as outlined in our standard late fee schedule.

    • Maximum Late Fee: The total late fee shall not exceed the cost of an additional Rental Period equivalent to the original booking unless otherwise specified.

  • Notification: If a late return is anticipated, the Renter must notify the Equipment Owner immediately through our platform to discuss possible extensions.

 

4. Care Guidelines

  • Proper Use:

    • Compliance: Renters must use the Equipment in accordance with the manufacturer's guidelines and for its intended purpose only.

    • Skill and Expertise: Renters should possess the necessary skills and expertise to operate the Equipment safely.

  • Maintenance:

    • Prohibited Actions: Renters must not modify, alter, or repair the Equipment without the Equipment Owner's express written consent.

    • Safe Keeping: Renters are responsible for keeping the Equipment secure and protected from theft, damage, or adverse environmental conditions.

  • Prohibited Uses:

    • Illegal Activities: The Equipment must not be used for any illegal activities or in violation of any laws or regulations.

    • Subleasing: Renters may not sublease or lend the Equipment to any third party for any reason.

 

5. Liability for Damage or Loss

  • Renter's Responsibility:

    • Damage: Renters are fully responsible for any damage to the Equipment that occurs during the Rental Period.

    • Loss or Theft: In the event of loss or theft of the Equipment, the Renter is responsible for the full replacement value as determined by the Equipment Owner. Insurance is required to make up the difference in repair/ replacement costs either from the Renter, Equipment Owner, or by our platform.

  • Inspection Upon Return:

    • Assessment: Upon return, the Equipment Owner will inspect the Equipment to assess its condition.

    • Damage Report: Any damages identified will be documented and reported to the Renter with evidence such as photographs or repair estimates.

  • Charges for Damage or Loss:

    • Repair Costs: The cost to repair damaged Equipment will be deducted from the Security Deposit. If the Security Deposit is insufficient, the Renter will be billed for the remaining amount.

    • Replacement Costs: In cases of total loss or irreparable damage, the Renter is responsible for the full replacement value of the Equipment.

  • Dispute Resolution:

    • Negotiation: Parties are encouraged to resolve disputes amicably through our platform's communication channels.

 

6. Insurance Requirements

  • Insurance:

    • Availability: Renters may have the option to purchase insurance coverage through our platform or a third-party provider to protect against potential liabilities.

    • Proof of Insurance: Equipment Owners do require Renters to provide proof of insurance prior to renting the Equipment.

  • Owner's Insurance:

    • Disclosure: Equipment Owners must disclose whether their own insurance policies cover rented Equipment and any requirements imposed on the Renter.

 

7. User Responsibilities

  • Compliance with Laws:

    • Legal Operation: Renters must operate the Equipment in compliance with all applicable local, state, and federal laws and regulations.

  • Notification of Issues:

    • Malfunctions: Renters must promptly notify the Equipment Owner of any malfunctions or issues experienced during the Rental Period.

    • Accidents: Any accidents or incidents resulting in damage or injury must be reported immediately to both the Equipment Owner and Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Co.

  • Return Condition:

    • Cleanliness: Equipment must be returned in the same condition of cleanliness as when received.

    • Components and Accessories: All components, accessories, manuals, and other items included with the Equipment must be returned.

 

8. Indemnification

  • Hold Harmless:

    • Renter's Indemnity: The Renter agrees to indemnify and hold harmless the Equipment Owner and Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Co. from any claims, liabilities, damages, or expenses arising out of the Renter use or misuse of the Equipment.

    • Owner's Indemnity: The Equipment Owner agrees to indemnify and hold harmless the Renter and Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Co. from any claims, liabilities, damages, or expenses arising out of defects in the Equipment or the Owner's failure to disclose material information.

 

9. Termination of Rental Agreement

  • Grounds for Termination:

    • Breach of Terms: Violation of any terms outlined in this agreement may result in immediate termination of the Rental Agreement and incur a penalty.

    • Unsafe Use: Evidence of unsafe or illegal use of the Equipment by the Renter.

  • Return Obligations:

    • Immediate Return: Upon termination, the Renter must return the Equipment immediately.

    • Forfeiture of Fees: Rental Fees and Security Deposits will be forfeited in cases of significant breach of these Terms.

 

10. Limitations of Liability

  • Indirect Damages:

    • Exclusion: Neither party shall be liable for indirect, incidental, or consequential damages arising out of the rental transaction.

  • Maximum Liability:

    • Cap on Liability: The maximum liability of Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Co. in connection with any rental transaction shall not exceed the total fees collected by us in relation to that transaction.

 

Acknowledgment and Acceptance

By participating in the Equipment rental process through Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Co., both Renters and Equipment Owners acknowledge that they have read, understood, and agree to be bound by these Equipment Rental Terms, as well as our general Terms of Service. Failure to comply with these Terms may result in penalties, including but not limited to account suspension or termination, forfeiture of fees, and legal action.

7. Buying and Selling Equipment

 

Sales & Transaction Policies:

These terms outline how transactions are conducted through Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Company’s ("we," "us," or "our") platform, including buying and selling equipment, return policies, warranties, and the assessment of equipment condition. By participating in transactions through our Services, you ("User," "Buyer," or "Seller") agree to these terms in addition to our general Terms of Service.

 

1. Transactions

a. Buying and Selling Equipment

 

  • Listing Equipment: Sellers can list equipment for sale on our marketplace by providing accurate and detailed information, including descriptions, specifications, condition, and clear photographs of the equipment.

 

  • Payment Processing:

    • Secure Payments: All payments are processed securely through our platform. Buyers agree to pay the total purchase price, including any applicable taxes and fees, at the time of purchase.

    • Fees: We may charge service fees or commissions for facilitating transactions. These fees will be transparently disclosed before the completion of any transaction.

 

  • Order Confirmation:

    • Acceptance: A transaction is considered accepted when the Seller confirms the order and payment has been successfully processed.

    • Cancellation: Sellers have the right to cancel orders prior to shipment under certain conditions, such as inventory errors. Buyers will receive a full refund in such cases.

 

  • Shipping and Delivery:

    • Seller Responsibilities: Sellers are responsible for securely packaging the equipment and shipping it to the Buyer within the specified handling time. Unless you choose to send your equipment to Chance Riley Scott, The Last Mile Studio, or I’m Tired of This, Grandpa Limted Co. for storage.

    • Shipping Costs: Shipping costs are determined by the Seller and will be disclosed at the time of purchase.

    • Tracking Information: Sellers must provide tracking information to Buyers once the equipment has been shipped.

 

Secure Transactions

  • Escrow Services: For high-value transactions, we may offer escrow services to protect both Buyers and Sellers until the transaction is satisfactorily completed.

  • Fraud Prevention: Transactions are monitored for fraudulent activity. Any suspicious transactions may be delayed or canceled to protect Users.

 

2. Return Policies

a. General Return Policy

 

  • Return Eligibility:

    • Return Window: Buyers have a specific period, typically 10 days from the date of receipt, to initiate a return.

    • Condition: Equipment must be returned in the same condition as received, including all original packaging, accessories, and documentation.

  • Return Reasons:

    • Defective or Damaged Equipment: If the equipment is defective or damaged upon arrival, the Buyer may return it for a full refund or replacement.

    • Not as Described: If the equipment significantly differs from the description provided in the listing, the Buyer may be eligible for a return.

 

b. Return Process

  • Initiating a Return:

    • Contact Seller: The Buyer must contact the Seller through our platform to request a return authorization, stating the reason for the return.

    • Approval: The Seller must approve or deny the return request within 3 business days.

  • Return Shipping:

    • Responsibility: Responsibility for return shipping costs depends on the reason for the return. If due to Seller error or defective equipment, the Seller covers the cost; otherwise, the Buyer is responsible.

    • Shipping Method: Returns should be shipped using a trackable method. The Buyer must provide the tracking information to the Seller.

  • Refunds and Exchanges:

    • Processing Refunds: Refunds will be issued to the original payment method within 10 business days after the Seller receives and inspects the returned equipment.

    • Exchanges: Exchanges are subject to the Seller's inventory availability and policies.

 

c. Non-Returnable Items

  • Final Sale Items: Certain equipment may be marked as "Final Sale" or "Non-Returnable" and are not eligible for return or refund.

  • Consumables: Items such as batteries, film stock, and other consumables are typically non-returnable once opened.

 

3. Warranties

a. Seller Warranties

 

  • Condition Warranty:

    • Accurate Description: Sellers warrant that the equipment is as described in the listing and is free from undisclosed defects.

    • Operational Guarantee: Equipment should be fully operational unless specified otherwise in the listing.

  • Title Warranty:

    • Ownership: Sellers warrant that they have full ownership of the equipment and the legal right to sell it.

 

b. Manufacturer's Warranties

  • Transferability:

    • Existing Warranties: If the equipment is still under the original manufacturer's warranty and the warranty is transferable, the Seller should provide any necessary documentation to the Buyer.

 

c. Disclaimer of Additional Warranties

  • As-Is Sales:

    • No Implied Warranties: Unless expressly stated, all equipment is sold "as is" without any implied warranties, including warranties of merchantability or fitness for a particular purpose.

  • Limitation of Liability:

    • Extent of Liability: Our liability and the Seller's liability are limited to 80% of the purchase price of the equipment.

 

4. Equipment Condition Assessments

a. Condition Ratings

  • New: Unused equipment in its original packaging with all original accessories.

  • Like New: Equipment that shows minimal to no signs of use and includes all original accessories.

  • Excellent: Equipment that is fully functional with very slight signs of wear.

  • Good: Equipment that is fully functional but shows signs of regular use.

  • Fair: Equipment that is operational but has noticeable cosmetic wear or minor functional issues, which should be disclosed.

 

b. Seller's Responsibilities

  • Honest Representation:

    • Detailed Descriptions: Sellers must provide accurate descriptions of the equipment's condition, including any flaws or defects.

    • High-Quality Images: Listings should include clear, high-resolution images showing all aspects of the equipment.

  • Verification:

    • Testing: Sellers should test equipment to ensure it is in the stated condition before listing and shipping.

 

c. Buyer's Responsibilities

  • Inspection Upon Receipt:

    • Timely Inspection: Buyers should inspect the equipment promptly upon receipt to confirm it matches the listing description.

    • Reporting Issues: Any discrepancies or issues must be reported to the Seller through our platform within 2 days of delivery.

 

d. Dispute Resolution

  • Mediation Services:

    • Assistance: In the event of a dispute over equipment condition, we may provide mediation services to facilitate a resolution.

    • Final Decision: While we aim to assist, we do not guarantee a resolution and are not liable for the outcome.

 

5. Return Policies for Sellers

  • Obligations:

    • Compliance: Sellers must honor their stated return policies and process returns in a timely manner.

    • Refund Timeliness: Refunds to Buyers must be issued promptly after receiving and inspecting the returned equipment.

  • Restocking Fees:

    • Disclosure: Any restocking fees must be clearly stated in the listing. Restocking fees cannot be imposed after the sale without prior disclosure.

 

6. Transaction Cancellations

  • Buyer's Right to Cancel:

    • Before Shipment: Buyers may request to cancel an order before the equipment has been shipped. Approval is at the Seller's discretion.

    • Refunds: If a cancellation is approved, the Buyer will receive a 90% refund.

  • Seller's Right to Cancel:

    • Inventory Issues: Sellers may cancel a transaction if the equipment is no longer available.

    • Notification: Sellers must notify the Buyer promptly and issue a full refund minus Our 5% fee.

 

7. Limitation of Liability

  • Indirect Damages:

    • Exclusion: Neither we nor the Sellers are liable for any indirect, incidental, or consequential damages resulting from transactions.

  • Maximum Liability:

    • Cap on Liability: Our maximum liability to any User is limited to the total fees we have received from that User in connection with the transaction giving rise to the liability.

 

8. Indemnification
